Trade Mark Registration Process:

Step1: Filing

  • You submit your Power of Attorney and FICA documents
  • We file your Trade Mark, OR if you so decide –
  • We first conduct an optional Comprehensive Trade Mark Search:
    • Scenario 1: No registered Trade Mark found, we proceed to file your Trade Mark
    • Scenario 2: Confusingly similar Trade Mark found, we advise on the best way forward

Step2: Examination

  • Within 6-12 Months, we receive the Registrar’s Examination Report
  • We consider the outcome and report on our findings:
    • Scenario 1: Unconditional acceptance, Oh-yeah! We proceed to the next phase.
    • Scenario 2: Specific requirements set by the Registrar, we fulfill them
    • Scenario 3: Provisional refusal, we advise on the best way forward**

Step3: Opposition

  • We Receive the Notice of Acceptance from the Registrar once in compliance
  • We publish your Trade Mark in the Patents and Trade Mark Journal
  • A compulsory 3 Month opposition term follows to allow for 3rd party opposition:
    • Scenario 1: No opposition, Booyah! We Proceed to the next phase
    • Scenario 2: A 3rd party opposition is lodged, We advise on the best way forward**

Step4: Certification of Grant

  • We obtain your certificate of grant and follow up with CIPC if required
  • We check and request corrections if necessary
  • We courier the original certificate (if required)**
  • Congratulations, your Trade Mark is registered and you enjoy exclusive use thereof!
  • The total Trade Mark registration period is around 12-18 Months (CIPC dependent)

Trade Mark registration is dependent on the CIPC process whether you follow the DIY Trade Mark Registration route or the Done For You Trade Mark Registration route. The CIPC service turnaround times are available on the CIPC website.

CIPC (Companies and Intellectual Property Commission) is a statutory body within the public administration and is the only way to register a Trade Mark whether you use a big law firm, or do it yourself. Some of the main functions of CIPC are the registration of companies, co-operatives and Intellectual Property (IP) Rights such as Trade Marks, Patents, Designs and Copyright as well as the maintenance thereof.

We know legal fee structures get very complicated and you often feel mislead. This is why we keep it as simple and transparent as possible. You only pay a once off fixed fee of R3700 for your Done-For-You Trade Mark registration, except in the following cases and depending how you wish to proceed – you remain in control:

  • If you require additional Trade Mark(s) to be registered 1,
  • If your Trade Mark application is provisionally refused by the Registrar and you need extra assistance 2,
  • Or if a 3rd party opposes your Trade Mark application 3.

We understand the cash-flow challenges during business startup which is why we offer a highly affordable payment plan for Done-for-You Trade Mark registration. We truly strive to make legal services and legal education accessible to all South African Entrepreneurs and Small Business Owners. This payment plan is for two or more Trade Marks and is structured as a 50% deposit followed by 3-6 equal monthly installments. The Deposit is payable on acceptance of Trade Mark registration quotation and the first installment is payable exactly one month after paying the deposit.

Yes! If at any time you change your mind about registering your Trade Mark, you can cancel the process, no questions asked. You will be refunded for the portion of the process we did not complete.

If you have been using your business or product name for a long time and it is important that you keep it, we might be able to assist in contesting the registered Trade Mark. If you are in the business startup phase, and you have the opportunity to change your business or product name, we’ll guide you in choosing a name you can Trade Mark. No, unfortunately not. The success of your Trade Mark registration is dependent on the CIPC process. We do however make every effort to ensure you have the best chance of successful registration. Typical reasons for unsuccessful registration include:

  • The Registrar does not unconditionally accept your application in Step 2 and you decide to cancel the registration or,
  • You receive 3rd party opposition in Step 3 and you decide to cancel the registration.

In all such instances, we will assess the situation and advise on the best way forward.
